Firstly, the claims for the compensation for the damages in personal injury must be submitted within the first three years of the action causing the whiplash injury.

This is meant to limit the aggravation, or wrongly blaming the accident or action that brought about the whiplash on the wrong person; what this means is that you might have had an incident many years ago that you suspect to have caused the injury while the injury was caused by a more recent activity or happening.
The whiplash act stipulates that the date from which the three years are counted to be the date the injury happened or the date you first acknowledged the injury. Many fraudulent claims could be made if there were no limitations on the period you are supposed to make the whiplash claim. The claims must be backed by medical examination documents that will indicate the severity and the real cause and pattern of the injury. Also the effect of the injury to you and your life must be proved to have a winning claim.
Unfortunately, the act also states that any whiplash claim on the whiplash injury can only be made when the claimant attains the legal age-eighteen years. To clarify this; a child who is around fifteen years and is involved in a whiplash injury will make claim only when he reaches eighteen years and will have the three consecutive years; till he is twenty one to make the claim.
